Terms & conditions
These terms govern use of PsychWell by therapists, clients, guardians, and practice supervisors. By creating an account or using the platform, you agree to them.
1. Not an emergency service
PsychWell is a scheduling, communication, and records tool for an existing therapeutic relationship. It is not a crisis or emergency service. If you are in immediate danger or experiencing a mental health emergency, contact a local emergency number or the nearest hospital directly rather than using this platform.
2. The therapist-client relationship
Clinical care is provided by the therapist, not by PsychWell. The platform hosts appointments, messaging, notes, and billing for that relationship but is not itself a party to it and does not supervise clinical judgment.
3. Accounts and access
Accounts are invite-only and tied to a specific role — client, therapist, guardian, or supervisor — which determines what you can see and do. You are responsible for keeping your login credentials confidential and for activity under your account.
4. Clinical notes and confidentiality
Clinical notes are private to the therapist by default and are encrypted at rest. Clients only see what a therapist explicitly shares. Handling of personal and health data follows the Digital Personal Data Protection Act, 2023, and confidentiality obligations consistent with the Mental Healthcare Act, 2017.
5. Payments
Session invoicing is generated on the platform; payment itself is made directly to your therapist via UPI, and marked received by them — PsychWell does not process, transmit, or hold any payment or card data. Refund and cancellation terms for a given session are set by the therapist or practice, not by PsychWell.
6. Guardian and supervisor access
Where enabled, a guardian may be granted read access to a minor's account, and a practice supervisor may be granted read access within their practice. This access is logged and does not extend to write actions unless explicitly stated.
7. Limitation of liability
PsychWell is provided on an “as is” basis. To the extent permitted by law, PsychWell is not liable for the clinical outcomes, advice, or conduct of any therapist or client using the platform.
8. Changes to these terms
These terms may be updated from time to time. Continued use of the platform after a change constitutes acceptance of the updated terms.
9. Governing law
These terms are governed by the laws of India.
